Ahmedabad, GCCI and its ADRC Committee joined hands with WIRC of ICSI Ahmedabad Chapter in organizing one day Conclave’24 on Corporate Dispute Resolution: Evolving a Way Forward. GCCI office bearers and members as well as office bearers and members of WIRC of ICSI Ahmedabad Chapter joined on the occasion.
In his Welcome Address, CS Yash Mehta, Chairman of the WIRC of ICSI Ahmedabad Chapter, highlighted the significance of the formation of the National Company Law Tribunal (NCLT), which has greatly impacted corporate governance and dispute resolution in India. He warmly welcomed all panelists and guests, emphasizing the importance of discussions on NCLT’s evolving role in the corporate legal landscape.
CS Rajesh Tarpara, Central Council Member (CCM) of the WIRC of ICSI, spoke about the unique role of Company Secretaries in navigating NCLT and other regulatory frameworks. He noted that Company Secretaries are increasingly recognized for their expertise and understanding of compliance and corporate governance matters.
He further elaborated that Company Secretaries have now been permitted to act as trademark agents, expanding their scope of professional services. Additionally, he announced that the Institute of Company Secretaries of India (ICSI) is set to launch an Alternate Dispute Resolution Centre (ADRC) at Noida, aimed at offering mediation, arbitration, and conciliation services.
GCCI President Shri Sandeep Engineer welcomed participants to the GCCI-NCLT Conclave 2024, organized by Gujarat Chamber of Commerce & Industry (GCCI) and Ahmedabad Branch of WIRC of The Institute of Company Secretaries of India (ICSI). He further elaborated upon the theme “Corporate Dispute Resolution: Evolving a Way Forward,”. He gave introduction of GCCI’s Alternate Dispute Resolution Centre (GCCI-ADRC) which offers a comprehensive range of arbitration, mediation and conciliation services. He thanked all esteemed guests and panelists for sparing their valuable time for the conclave. He congratulated GCCI ADRC Committee Chairman Shri Mitulbhai Shelat for his efforts in organizing the conclave.
Sharing his thoughts GCCI Hon. Treasurer Shri Sudhanshu Mehta mentioned that Corporate dispute, be it between two corporate units, or with the clients, or with the Government is always time consuming and expensive. It is an unnecessary road block. He remarked that well defined policies and processes can help reduce such litigations.
Shri Mitul Shelat, Chairman, GCCI Alternate Dispute Resolution Centre (ADRC) Committee, emphasized the increasing need for institutional arbitration with fixed costs and time-bound schedules to address the growing volume of corporate and general litigations in India. He further highlighted the role of the ADRC in offering affordable arbitration, mediation, conciliation and other dispute resolution services, helping to reduce the burden on the judiciary. As industries expand and disputes become more common, the ADRC is committed to refining its practices, promoting mediation, and setting benchmarks for efficient and transparent dispute resolution to meet the evolving needs of businesses and society.
The panel discussion on “Areas of Practice in NCLT” was both engaging and insightful, featuring distinguished panelists including CS (IP) Ravi Kapoor, Practicing Company Secretary and Insolvency Professional; Adv. Nipun Singhvi, Managing Partner at NSA Legal; Adv. Arjun Sheth, Founder of Arjun Sheth & Associates; and Adv. Noopur Dalal, Partner at Thakkar & Dalal Advocates. The session was expertly moderated by CS Parshwa Shah, Programme Director and MCM. Key topics covered during the discussion included corporate governance and shareholder disputes, the role of NCLT in corporate insolvency resolution, mergers, acquisitions and corporate restructuring, the Insolvency and Bankruptcy Code, and the processes of NCLT and ADR.
Equally engaging was the panel discussion on “Alternate Dispute Resolution,” led by esteemed panelists, Hon’ble Justice (Retired) P.P. Bhatt of the Gujarat High Court, Senior Advocate Dhaval Dave, Senior Advocate Devang Nanavati, and Senior Advocate Unmesh Shukla, all from the Gujarat High Court. The session was moderated by Adv. Mitulbhai Shelat, Chairman of the ADRC Committee at GCCI. Key topics discussed included an introduction to conciliation, the conciliation process, and the differences between ad-hoc arbitration and institutional arbitration. The event concluded after vote of thanks by CS Jaymeen Trivedi, Secretary, Ahmedabad Chapter of WIRC of ICSI.
